Terms of Service

Acceptance of Terms

By accessing or using Scrollr ("the Platform"), including the website at myscrollr.com, the Scrollr desktop application, and any associated APIs or services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will indicate the date of the most recent revision at the top of this page.

Eligibility

You must be at least 13 years of age to use the Platform. If you are under 18, you represent that you have your parent or guardian's permission to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.

Account Registration

Certain features of the Platform require you to create an account through our authentication provider (Logto). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate information during registration and to update your information as necessary. We reserve the right to suspend or terminate accounts that violate these Terms.

Use of the Platform

The Platform aggregates publicly available and third-party data including financial market data, sports scores, RSS news feeds, and fantasy sports information. This data is provided for informational and entertainment purposes only.

You may use the Platform for personal, non-commercial purposes in accordance with these Terms and our Acceptable Use Policy. You may not use the Platform in any way that violates applicable laws or regulations.

Desktop Application

The Scrollr desktop application displays a real-time ticker overlay on your screen. The application communicates with our servers to receive real-time data updates via Server-Sent Events (SSE). The application does not read, collect, or transmit the content of other applications or web pages.

By installing the application, you grant it the permissions required for operation, which include network access for communication with our API servers and local storage for your preferences.

Intellectual Property

The Scrollr platform source code is licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). This means the source code is freely available, and you may use, modify, and distribute it in accordance with the terms of that license.

The Scrollr name, logo, and branding are trademarks of the project maintainers and may not be used without permission. Third-party data displayed through the Platform (market data, sports scores, news feeds, fantasy sports data) remains the property of its respective owners.

Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL THE SCROLLR PROJECT, ITS MAINTAINERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

THIS LIMITATION APPLIES WHETHER THE DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately.

You may terminate your account at any time by discontinuing use of the Platform. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to limitation of liability and intellectual property provisions.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of competent jurisdiction within the United States.
